1. Scope of Application<\/strong><\/p>

1.1 Diese Allgemeinen Gesch\u00e4ftsbedingungen (nachfolgend „AGB“) der Veronika Conen, handelnd unter „Sportsfreund Studios“ (nachfolgend „Verk\u00e4ufer“), gelten f\u00fcr alle Vertr\u00e4ge zur Lieferung von Waren, die ein Verbraucher oder Unternehmer (nachfolgend \u201eKunde\u201c) mit dem Verk\u00e4ufer hinsichtlich der vom Verk\u00e4ufer in seinem Online-Shop dargestellten Waren abschlie\u00dft. Hiermit wird der Einbeziehung von eigenen Bedingungen des Kunden widersprochen, es sei denn, es ist etwas anderes vereinbart.
1.2 F\u00fcr Vertr\u00e4ge zur Lieferung von Gutscheinen gelten diese AGB entsprechend, sofern insoweit nicht etwas Abweichendes geregelt ist.
1.3 Verbraucher im Sinne dieser AGB ist jede nat\u00fcrliche Person, die ein Rechtsgesch\u00e4ft zu Zwecken abschlie\u00dft, die \u00fcberwiegend weder ihrer gewerblichen noch ihrer selbst\u00e4ndigen beruflichen T\u00e4tigkeit zugerechnet werden k\u00f6nnen.
1.4 Unternehmer im Sinne dieser AGB ist eine nat\u00fcrliche oder juristische Person oder eine rechtsf\u00e4hige Personengesellschaft, die bei Abschluss eines Rechtsgesch\u00e4fts in Aus\u00fcbung ihrer gewerblichen oder selbst\u00e4ndigen beruflichen T\u00e4tigkeit handelt.

2) Conclusion of the Contract<\/b>
2.1 The product descriptions in the Seller\u2019s online shop do not constitute binding offers on the part of the Seller, but merely serve the purpose of submitting a binding offer by the Client.
2.2 Der Kunde kann das Angebot \u00fcber das in den Online-Shop des Verk\u00e4ufers integrierte Online-Bestellformular abgeben. Dabei gibt der Kunde, nachdem er die ausgew\u00e4hlten Waren in den virtuellen Warenkorb gelegt und den elektronischen Bestellprozess durchlaufen hat, durch Klicken des den Bestellvorgang abschlie\u00dfenden Buttons ein rechtlich verbindliches Vertragsangebot in Bezug auf die im Warenkorb enthaltenen Waren ab. Ferner kann der Kunde das Angebot auch per E-Mail, per Online-Kontaktformular, postalisch oder telefonisch gegen\u00fcber dem Verk\u00e4ufer abgeben.
2.3 Der Verk\u00e4ufer kann das Angebot des Kunden innerhalb von f\u00fcnf Tagen annehmen,
– indem er dem Kunden eine schriftliche Auftragsbest\u00e4tigung oder eine Auftragsbest\u00e4tigung in Textform (Fax oder E-Mail) \u00fcbermittelt, wobei insoweit der Zugang der Auftragsbest\u00e4tigung beim Kunden ma\u00dfgeblich ist, oder
- by delivering ordered goods to the Client; insofar receipt of goods by the Client is decisive, or
- by requesting the Client to pay after he placed his order.
Liegen mehrere der vorgenannten Alternativen vor, kommt der Vertrag in dem Zeitpunkt zustande, in dem eine der vorgenannten Alternativen zuerst eintritt. Die Frist zur Annahme des Angebots beginnt am Tag nach der Absendung des Angebots durch den Kunden zu laufen und endet mit dem Ablauf des f\u00fcnften Tages, welcher auf die Absendung des Angebots folgt. Nimmt der Verk\u00e4ufer das Angebot des Kunden innerhalb vorgenannter Frist nicht an, so gilt dies als Ablehnung des Angebots mit der Folge, dass der Kunde nicht mehr an seine Willenserkl\u00e4rung gebunden ist.
2.4 Bei Auswahl einer von PayPal angebotenen Zahlungsart erfolgt die Zahlungsabwicklung \u00fcber den Zahlungsdienstleister PayPal (Europe) S.\u00e0 r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxemburg (im Folgenden: \u201ePayPal\u201c), unter Geltung der PayPal-Nutzungsbedingungen, einsehbar unter https:\/\/www.paypal.com\/de\/webapps\/mpp\/ua\/useragreement-full oder – falls der Kunde nicht \u00fcber ein PayPal-Konto verf\u00fcgt \u2013 unter Geltung der Bedingungen f\u00fcr Zahlungen ohne PayPal-Konto, einsehbar unter https:\/\/www.paypal.com\/de\/webapps\/mpp\/ua\/privacywax-full. Zahlt der Kunde mittels einer im Online-Bestellvorgang ausw\u00e4hlbaren von PayPal angebotenen Zahlungsart, erkl\u00e4rt der Verk\u00e4ufer schon jetzt die Annahme des Angebots des Kunden in dem Zeitpunkt, in dem der Kunde den Button anklickt, welcher den Bestellvorgang abschlie\u00dft.
2.5 Bei der Abgabe eines Angebots \u00fcber das Online-Bestellformular des Verk\u00e4ufers wird der Vertragstext nach dem Vertragsschluss vom Verk\u00e4ufer gespeichert und dem Kunden nach Absendung von dessen Bestellung in Textform (z. B. E-Mail, Fax oder Brief) \u00fcbermittelt. Eine dar\u00fcber hinausgehende Zug\u00e4nglichmachung des Vertragstextes durch den Verk\u00e4ufer erfolgt nicht.
2.6 Vor verbindlicher Abgabe der Bestellung \u00fcber das Online-Bestellformular des Verk\u00e4ufers kann der Kunde m\u00f6gliche Eingabefehler durch aufmerksames Lesen der auf dem Bildschirm dargestellten Informationen erkennen. Ein wirksames technisches Mittel zur besseren Erkennung von Eingabefehlern kann dabei die Vergr\u00f6\u00dferungsfunktion des Browsers sein, mit deren Hilfe die Darstellung auf dem Bildschirm vergr\u00f6\u00dfert wird. Seine Eingaben kann der Kunde im Rahmen des elektronischen Bestellprozesses so lange \u00fcber die \u00fcblichen Tastatur- und Mausfunktionen korrigieren, bis er den Button anklickt, welcher den Bestellvorgang abschlie\u00dft.
2.7 F\u00fcr den Vertragsschluss stehen unterschiedliche Sprachen zur Verf\u00fcgung. Die konkrete Sprachauswahl wird im Online-Shop angezeigt.
2.8 Order processing and contacting usually takes place via e-mail and automated order processing. It is the Client\u2019s responsibility to ensure that the e-mail address he provides for the order processing is accurate so that e-mails sent by the Seller can be received at this address. In particular, it is the Client`s responsibility, if SPAM filters are used, to ensure that all e-mails sent by the Seller or by third parties commissioned by the Seller with the order processing can be delivered.<\/p>

3) Right to Cancel<\/b>
3.1 Consumers are entitled to the right to cancel.
3.2 Detailed information about the right to cancel are provided in the Seller\u2019s instruction on cancellation.
3.3 Das Widerrufsrecht gilt nicht f\u00fcr Verbraucher, die zum Zeitpunkt des Vertragsschlusses keinem Mitgliedstaat der Europ\u00e4ischen Union angeh\u00f6ren und deren alleiniger Wohnsitz und Lieferadresse zum Zeitpunkt des Vertragsschlusses au\u00dferhalb der Europ\u00e4ischen Union liegen.<\/p>

4) Prices and Payment Conditions<\/b>
4.1 Unless otherwise stated in the Seller\u2019s product description, prices indicated are total prices including the statutory sales tax. Delivery costs, where appropriate, will be indicated separately in the respective product description
4.2 Payment can be made using one of the methods mentioned in the Seller\u2019s online shop.
4.3 In case of delivery to countries outside the European Union, additional costs may incur in individual cases for which the Seller is not responsible and which have to be borne by the Client. This includes for example transfer fees charged by banking institutes (transfer charges, exchange fees) or import duties or taxes (customs). Such costs regarding money transfer may also incur, if delivery is not made in a country outside the European Union and the Client carries out the payment from a country outside the European Union.
4.4 Ist Vorauskasse per Banku\u0308berweisung vereinbart, ist die Zahlung sofort nach Vertragsabschluss f\u00e4llig, sofern die Parteien keinen sp\u00e4teren F\u00e4lligkeitstermin vereinbarthaben.<\/p>

5. Shipment and Delivery Conditions<\/b>\u00a0<\/p>

5.1 Bietet der Verk\u00e4ufer den Versand der Ware an, so erfolgt die Lieferung innerhalb des vom Verk\u00e4ufer angegebenen Liefergebietes an die vom Kunden angegebene Lieferanschrift, sofern nichts anderes vereinbart ist. Bei der Abwicklung der Transaktion ist die in der Bestellabwicklung des Verk\u00e4ufers angegebene Lieferanschrift ma\u00dfgeblich. Abweichend hiervon ist bei Auswahl der Zahlungsart PayPal die vom Kunden zum Zeitpunkt der Bezahlung bei PayPal hinterlegte Lieferanschrift ma\u00dfgeblich.
5.2 Scheitert die Zustellung der Ware aus Gr\u00fcnden, die der Kunde zu vertreten hat, tr\u00e4gt der Kunde die dem Verk\u00e4ufer hierdurch entstehenden angemessenen Kosten. Dies gilt im Hinblick auf die Kosten f\u00fcr die Hinsendung nicht, wenn der Kunde sein Widerrufsrecht wirksam aus\u00fcbt. F\u00fcr die R\u00fccksendekosten gilt bei wirksamer Aus\u00fcbung des Widerrufsrechts durch den Kunden die in der Widerrufsbelehrung des Verk\u00e4ufers hierzu getroffene Regelung.
5.3 Handelt der Kunde als Unternehmer, geht die Gefahr des zuf\u00e4lligen Untergangs und der zuf\u00e4lligen Verschlechterung der verkauften Ware auf den Kunden \u00fcber, sobald der Verk\u00e4ufer die Sache dem Spediteur, dem Frachtf\u00fchrer oder der sonst zur Ausf\u00fchrung der Versendung bestimmten Person oder Anstalt ausgeliefert hat. Handelt der Kunde als Verbraucher, geht die Gefahr des zuf\u00e4lligen Untergangs und der zuf\u00e4lligen Verschlechterung der verkauften Ware grunds\u00e4tzlich erst mit \u00dcbergabe der Ware an den Kunden oder eine empfangsberechtigte Person \u00fcber. Abweichend hiervon geht die Gefahr des zuf\u00e4lligen Untergangs und der zuf\u00e4lligen Verschlechterung der verkauften Ware auch bei Verbrauchern bereits auf den Kunden \u00fcber, sobald der Verk\u00e4ufer die Sache dem Spediteur, dem Frachtf\u00fchrer oder der sonst zur Ausf\u00fchrung der Versendung bestimmten Person oder Anstalt ausgeliefert hat, wenn der Kunde den Spediteur, den Frachtf\u00fchrer oder die sonst zur Ausf\u00fchrung der Versendung bestimmte Person oder Anstalt mit der Ausf\u00fchrung beauftragt und der Verk\u00e4ufer dem Kunden diese Person oder Anstalt zuvor nicht benannt hat.
5.4 Der Verk\u00e4ufer beh\u00e4lt sich das Recht vor, im Falle nicht richtiger oder nicht ordnungsgem\u00e4\u00dfer Selbstbelieferung vom Vertrag zur\u00fcckzutreten. Dies gilt nur f\u00fcr den Fall, dass die Nichtlieferung nicht vom Verk\u00e4ufer zu vertreten ist und dieser mit der gebotenen Sorgfalt ein konkretes Deckungsgesch\u00e4ft mit dem Zulieferer abgeschlossen hat. Der Verk\u00e4ufer wird alle zumutbaren Anstrengungen unternehmen, um die Ware zu beschaffen. Im Falle der Nichtverf\u00fcgbarkeit oder der nur teilweisen Verf\u00fcgbarkeit der Ware wird der Kunde unverz\u00fcglich informiert und die Gegenleistung unverz\u00fcglich erstattet.
5.5 Selbstabholung ist aus logistischen Gr\u00fcnden nicht m\u00f6glich.

6. Reservation of Proprietary Rights<\/b><\/p>

If the Seller provides advance deliveries, he retains title of ownership to the delivered goods, until the purchase price owed has been paid in full.<\/p>

7. Warranty<\/b>Soweit sich aus den nachfolgenden Regelungen nichts anderes ergibt, gelten die Vorschriften der gesetzlichen M\u00e4ngelhaftung. Hiervon abweichend gilt bei Vertr\u00e4gen zur Lieferung von Waren:
7.1 Handelt der Kunde als Unternehmer,
– hat der Verk\u00e4ufer die Wahl der Art der Nacherf\u00fcllung;
– betr\u00e4gt bei neuen Waren die Verj\u00e4hrungsfrist f\u00fcr M\u00e4ngel ein Jahr ab Ablieferung der Ware;
– sind bei gebrauchten Waren die Rechte und Anspr\u00fcche wegen M\u00e4ngeln ausgeschlossen;
- the limitation period shall not recommence if a replacement delivery is made within the scope of liability for defects.
7.2 Handelt der Kunde als Verbraucher gilt bei Vertr\u00e4gen zur Lieferung gebrauchter Waren mit der Einschr\u00e4nkung der nachfolgenden Ziffer: Die Verj\u00e4hrungsfrist f\u00fcr M\u00e4ngelanspr\u00fcche betr\u00e4gt ein Jahr ab Ablieferung der Ware, wenn dies zwischen den Parteien ausdr\u00fccklich und gesondert vertraglich vereinbart wurde und der Kunde vor der Abgabe seiner Vertragserkl\u00e4rung von der Verk\u00fcrzung der Verj\u00e4hrungsfrist eigens in Kenntnis gesetzt wurde.
7.3 Die vorstehend geregelten Haftungsbeschr\u00e4nkungen und Fristverk\u00fcrzungen gelten nicht
– f\u00fcr Schadensersatz- und Aufwendungsersatzanspr\u00fcche des Kunden,
– f\u00fcr den Fall, dass der Verk\u00e4ufer den Mangel arglistig verschwiegen hat,
– f\u00fcr Waren, die entsprechend ihrer \u00fcblichen Verwendungsweise f\u00fcr ein Bauwerk verwendet worden sind und dessen Mangelhaftigkeit verursacht haben,
– f\u00fcr eine ggf. bestehende Verpflichtung des Verk\u00e4ufers zur Bereitstellung von Aktualisierungen f\u00fcr digitale Produkte, bei Vertr\u00e4gen zur Lieferung von Waren mit digitalen Elementen.
7.4 Dar\u00fcber hinaus gilt f\u00fcr Unternehmer, dass die gesetzlichen Verj\u00e4hrungsfristen f\u00fcr einen ggf. bestehenden gesetzlichen R\u00fcckgriffsanspruch unber\u00fchrt bleiben.
7.5 Handelt der Kunde als Kaufmann i.S.d. \u00a7 1 HGB, trifft ihn die kaufm\u00e4nnische Untersuchungs- und R\u00fcgepflicht gem\u00e4\u00df \u00a7 377 HGB. Unterl\u00e4sst der Kunde die dort geregelten Anzeigepflichten, gilt die Ware als genehmigt.
7.6 Handelt der Kunde als Verbraucher, so wird er gebeten, angelieferte Waren mit offensichtlichen Transportsch\u00e4den bei dem Zusteller zu reklamieren und den Verk\u00e4ufer hiervon in Kenntnis zu setzen. Kommt der Kunde dem nicht nach, hat dies keinerlei Auswirkungen auf seine gesetzlichen oder vertraglichen M\u00e4ngelanspr\u00fcche.<\/p>

8. Redemption of promotional vouchers<\/b>
8.1 Gutscheine, die vom Verk\u00e4ufer im Rahmen von Werbeaktionen mit einer bestimmten G\u00fcltigkeitsdauer unentgeltlich ausgegeben werden und die vom Kunden nicht k\u00e4uflich erworben werden k\u00f6nnen (nachfolgend „Aktionsgutscheine“), k\u00f6nnen nur im Online-Shop des Verk\u00e4ufers und nur im angegebenen Zeitraum eingel\u00f6st werden.
8.2 Promotional vouchers can only be redeemed by consumers.
8.3 Individual products can be excluded from the voucher campaign if a corresponding restriction results from the content of the campaign voucher.
8.4 Promotional vouchers can only be redeemed before completing the ordering process. Subsequent offsetting is not possible.

Consequences of Cancelliation<\/strong>
